By scheduling, booking, or using any Abundance Services LLC doing business as Clearout Junk services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These Terms constitute a legal agreement between you ("Customer") and Abundance Services LLC doing business as Clearout Junk ("Company", "we", "us", "our").

If you are booking services on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Abundance Services LLC doing business as Clearout Junk provides professional junk removal and disposal services, including but not limited to:

• Residential and commercial junk removal
• Furniture and appliance removal
• Construction debris removal
• Estate and foreclosure cleanouts
• Electronic waste disposal
• Donation and recycling coordination

All services are performed by trained, uniformed professionals in accordance with local, state, and federal regulations. We reserve the right to refuse service for any reason, including but not limited to safety concerns or item restrictions.

3.1 Booking Process

Services may be booked via phone, website, or other approved methods. All bookings are subject to availability and confirmation by Abundance Services LLC doing business as Clearout Junk.

3.2 Scheduling Windows

We provide 2-4 hour arrival windows for scheduled appointments. While we strive to arrive within the scheduled window, delays may occur due to unforeseen circumstances. We will notify customers of any significant delays.

3.3 Access Requirements

Customer must ensure clear access to items for removal. This includes unlocked gates, cleared pathways, and available parking for our vehicles. Additional charges may apply for difficult access situations.

4.1 Pricing Structure

Pricing is based on volume (space occupied in truck) and type of items removed. Final pricing is determined on-site before work begins and must be approved by customer.

4.2 Payment Terms

• Payment is due upon completion of services
• We accept cash, check, and major credit cards
• Additional fees may apply for after-hours or emergency services
• Bounced check fee: $35

4.3 Price Changes

If the scope of work changes significantly from the original estimate, we will provide a revised quote for customer approval before proceeding.

4.4 Minimum Charges

A minimum service charge of $149 applies to all jobs, regardless of items removed.

5.1 Description of SMS Use Cases

By opting in to receive text messages from Abundance Services LLC DBA Clearout Junk, you may receive messages for the following purposes:

• Appointment reminders — Notifications about upcoming scheduled services
• Order and service confirmations — Confirmation of bookings, quotes, and completed services
• Account notifications — Updates related to your account, payments, or service status

5.5 Message & Data Rates

Message and data rates may apply depending on your mobile carrier and plan. Abundance Services LLC DBA Clearout Junk is not responsible for any messaging fees, data charges, or other costs imposed by your wireless carrier. Please contact your carrier for details about your text messaging plan and any applicable charges.

5.6 Carrier Liability Disclaimer

Wireless carriers, including but not limited to AT&T, T-Mobile, Verizon, and Sprint, are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and network availability. Abundance Services LLC DBA Clearout Junk is not responsible for messages that are not received due to carrier issues, device incompatibility, or other factors outside of our control.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Customers are responsible for:

• Accurately describing items to be removed during booking
• Ensuring legal ownership or authority to dispose of all items
• Removing or securing valuable items, personal documents, and sentimental belongings
• Providing safe and clear access to removal areas
• Identifying any hazardous materials or restricted items
• Being present during service or designating an authorized representative
• Payment of services as agreed upon

Abundance Services LLC doing business as Clearout Junk will:

• Provide professional, uniformed crew members
• Use protective materials to prevent damage to customer property
• Remove items safely and efficiently
• Clean up work area after removal
• Dispose of items in accordance with local regulations
• Make reasonable efforts to donate or recycle appropriate items
• Provide receipt and documentation of services performed

8.1 Company Insurance

Abundance Services LLC doing business as Clearout Junk maintains general liability insurance and workers' compensation coverage as required by law. Proof of insurance is available upon request.

8.2 Property Damage

We take great care to prevent property damage. In the unlikely event that our crew causes damage to customer property, Abundance Services LLC doing business as Clearout Junk will repair or reimburse for damages up to the limits of our insurance coverage.

8.3 Limitation of Liability

Abundance Services LLC doing business as Clearout Junk's total liability for any claim shall not exceed the amount paid for services rendered. We are not liable for:

• Indirect, incidental, or consequential damages
• Items mistakenly removed due to customer error in identification
• Pre-existing damage to property
• Damage caused by customer's failure to provide safe access
• Loss of use, revenue, or profit

8.4 Customer Property Insurance

Customers are advised to check with their homeowner's or renter's insurance regarding coverage for property damage during junk removal services.

Abundance Services LLC doing business as Clearout Junk cannot accept the following items:

If restricted items are discovered during service, Abundance Services LLC doing business as Clearout Junk reserves the right to refuse removal and may charge for time spent on-site. We can provide referrals for proper disposal of restricted items.

10.1 Customer Cancellations

• 24+ hours notice: No cancellation fee
• 2-24 hours notice: $50 cancellation fee
• Less than 2 hours or no-show: $100 cancellation fee

10.2 Company Cancellations

Abundance Services LLC doing business as Clearout Junk may cancel or reschedule services due to weather, equipment failure, or other circumstances beyond our control. No cancellation fee will be charged, and we will reschedule at customer's convenience.

10.3 Rescheduling

Services may be rescheduled up to 24 hours before the scheduled appointment without penalty. Rescheduling with less notice may incur fees.

11.1 Initial Resolution

We encourage customers to contact us directly at (936) 228-9328 or admin@clearoutjunk.com to resolve any concerns or disputes.

11.2 Mediation

If a dispute cannot be resolved directly, both parties agree to attempt resolution through mediation before pursuing legal action.

11.3 Governing Law

These Terms are governed by the laws of the State of Texas. Any legal proceedings must be conducted in Montgomery County, Texas.

11.4 Limitation Period

Any claims must be brought within one (1) year of the date of service or the claim will be barred.

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your personal information, including information collected through our SMS/text messaging program.
